As we enter the second year of the COVID pandemic, the ever-changing rules governing the workplace will continue having an impact on how businesses operate. The Cal- OSHA requirements and guidelines from state and local agencies on quarantine, return to work rules, and pay for leave due to COVID will continue to be in place (with frequent amendments) for the foreseeable future. In addition, the status of federal vaccine mandates remains uncertain.
Although COVID remains a primary focus for employers, there have been a variety of new employment laws adopted that become effective this January, along with important court decisions impacting wage and hour compliance.
At this informative virtual briefing session, Erick Becker, head of the Labor and Employment practice at Cummins and White, will update you on all of the changes to employment law on both the state and federal levels.

This Legal Update will address new California laws, including:
(SB 331): Prohibits restrictions on employees sharing information on harassment and discrimination and requires specific carve out language in settlement and separation agreements and non-disclosure agreements.
(SB 807): Extends retention of personnel records to four years.
(AB 1003): Authorizes criminal penalties against owners and managers for wage theft.
(AB 1033): CFRA Expansion Adding Parents-in-Law as family members.
Cal-OSHA Emergency COVID regulations:
Changes to regulations taking effect in January including:

- Changes to quarantine rules for vaccinated employees exposed to COVID.
- Requirements that masks be double-ply.
- Return to work guidelines for vaccinated and unvaccinated employees.
Federal vaccine mandates for large employers:
- Update on Supreme Court ruling on enforceability and possible implementation dates.
(AB 654) Additional employee notice requirements if exposure to COVID occurs at work.
Important court decisions on meal breaks, rounding and calculating meal and rest penalties and best practices for compliance.
