The End of Independent Contractors and Mandatory Arbitration?

In the 2019 legislative session, Sacramento was determined to make headlines by adopting far reaching legislation – including new laws making it more difficult for California employers. The highest profile legislation, AB 5, was targeted at the large “gig economy” companies, such as Uber, Lyft and Grubhub. AB 5 makes it nearly impossible for these companies to continue using independent contractors, and instead requires them to have employees, which can then be unionized. Unfortunately, many businesses and workers who prefer the independent contractor model are collateral damage.
In addition, Sacramento took aim at arbitration of employment disputes, seeking to take another protection against expensive class action lawsuits away from employers.
